6.1.1

The following report of the City Solicitor dated February 22, 2021, was provided:


"City Council at its meeting held on December 21, 2020, resolved that the City Solicitor be requested to prepare an amendment to Bylaw No. 8232, The Knox United Church Heritage Designation Bylaw, 2003, with such amendment limited to amending the legal land description to reflect the approved subdivision.


In this regard we enclose proposed Bylaw No. 9737, The Knox United Church Heritage Designation Amendment Bylaw, 2021.  The Heritage Property Act requires that a Notice of Intention to Amend Heritage Designation Bylaw be served on the Registrar of Heritage Property and the owner of the relevant property. As well, the Notice must be registered against the title to the property and advertised in at least one issue of a newspaper in general circulation in the municipality. All of these prerequisites have been undertaken. The date advertised in the Notice for City Council’s consideration of this matter was January 9, 2021.


The Heritage Property Act further provides that anyone wishing to object to the proposed designation must serve Council with an objection stating the reason for the objection and providing the relevant facts. The objection must be served at least three days prior to the Council meeting at which the Bylaw is to be considered.


If an objection is received, Council shall either refer the matter to the review board established under The Heritage Property Act or withdraw the proposed bylaw."

Mayor Clark introduced the item and a motion to consider first reading of Bylaw No. 9737 was passed.

Lesley Anderson, Director of Planning and Development, Community Services Department, reviewed the Municipal Heritage Property Designation indicating that a Notice of Objection was received and outlined the process.

Lenore Swystun, Chair of the Municipal Heritage Advisory Committee, spoke against the amendment and asked for the Bylaw to be withdrawn.

Marcel de la Gorgendiere, Board of Directors, Knox United Church, spoke in support of the amendment indicating that it is to remove the heritage designation from the land, not the church and outlined the impact of the transfer. 

Ross Hinther spoke against the bylaw amendment.  He displayed a photo of the Church during his presentation.

Karl Miller, CEO of Meridian Developments, spoke in support of the amendment displaying slides of other similar developments in other jurisdictions.

Bertrand Bartake , Kindrachuk Agrey, indicated that they are working with Meridian on the project and displayed slides regarding the history of the site as well as similar developments in other jurisdictions.

Susan Cross spoke against the proposed amendment.

Peggy Sarjeant, Saskatoon Heritage Society, spoke against the proposed amendment to allow for further exploration to celebrating heritage assets.

Brent Penner, Executive Director of Downtown YXE, spoke in support of the project outlining various reasons.

Norma Klassen spoke against the amendment.

Due to the response to COVID-19, there was no attendance by members of the public and therefore no speakers from the gallery.

Theresa Kirkpatrick reminded Council of the 300 residents that signed a petition in opposition to the project.
 
Mark Kelleher, BlackRock Developments Limited, indicated that he has heard the concerns of the neighbourhood expressing that the development will be a benefit to the neighbourhood.
